Obama Administration Sues Arizona Over Immigration Law

In a move that shocked absolutely no one, the Obama Administration filed a lawsuit in Federal Court to block the implementation of Arizona’s new anti-illegal immigration law formerly known as SB1070.

The suit alleges that Arizona’s new law infringes upon duties of the federal government and violates the Constitution’s Supremacy Clause.  According to many legal experts, this claim should not stand because the Arizona law does not classify something as illegal, that is not already so classified under existing federal law.  Even before his law was passed, Arizona law enforcement agencies had the right to enforce federal immigration law under the precept known as concurrent jurisdiction.  The new Arizona law simply makes it mandatory for all law enforcement agencies in the state to do so.

The suit fails to take into account the rights that all states, Arizona included, have under the tenth amendment to the U.S. Constitution.  This appears to be yet another attack on the tenth amendment by an administration which seems to have made such attacks a way of life.
